This Privacy Policy sets forth the principles of processing by PANEK S.A. personal data and information about Users of the PANEK Carsharing service. 

  1. INTRODUCTORY PROVISIONS.

Definitions:

    1. Privacy Policy - this document,
    2. PANEK - PANEK S.A. with its registered office in Warsaw, ul. Grójecka 208, 02-390 Warsaw,
    3. PANEK Carsharing - car rental service on terms specified in the PANEK Carsharing Service Terms and Conditions, available at panekcs.pl,
    4. User - a person who: registered with PANEK Carsharing, has or had an active account with PANEK Carsharing, a visitor to a website or websites concerning PANEK Carsharing, in particular panekcs.pl, who installed the mobile application PANEK Carsharing
    5. Regulation - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
  1. PERSONAL DATA PROTECTION ADMINISTRATOR AND OFFICER. CONTACT DETAILS.
    1. Personal data and information about Users are collected and processed by PANEK S.A. with its registered office in Warsaw at ul. Grójecka 208, 02-390 Warsaw, which is the administrator of Users' personal data.
    2. Users may contact PANEK in the following ways:

  1. Personal Data Protection Officer was appointed in PANEK, who the Users may contact about matters related to the processing of personal data in the following way:

    • in writing at the address: PANEK S.A., ul. Grójecka 208, 02-390 Warszawa with an annotation "IODO" (Personal Data Protection Inspector).
  1. PERSONAL DATA PROCESSING OBJECTIVES AND THE LEGAL BASIS FOR PROCESSING.

PANEK processes personal data and information about Users for the following purposes:

    1. conclusion and implementation of the contract / contracts (Article 6(1)(b) of the Regulation);
    2. providing services electronically, including access services to the PANEK Carsharing mobile application (Article 6(1)(b) of the Regulation);
    3. establishing, defending and pursuing the claims (Article 6(1)(f) of the Regulation);
    4. performing direct marketing of the products and services of PANEK (Article 6(1)(f) of the Regulation);
    5. sending information about promotions, contests, marketing activities by e-mail, SMS, MMS or in a mobile application (Article 6(1)(a) of the Regulation);
    6. marketing through telephone conversations (Article 6(1)(a) of the Regulation),
    7. research on the satisfaction with cooperation between Users and PANEK and with the services provided by PANEK (Article 6(1)(f) of the Regulation),
    8. fulfillment of PANEK’s legal obligations (eg providing information to authorities authorized to request it) (Article 6(1)(c) of the Regulation),
    9. conducting the operations of PANEK (reporting, statistics) (Article 6(1)(f) of the Regulation),
    10. archiving in case that it is necessary for PANEK to prove the facts or to prove having performed its duties (Article 6(1)(f) of the Regulation).
  1. PROCESSED PERSONAL DATA AND INFORMATION ON THE USER.
    1. PANEK processes the following personal data of the User: first name/ names, surname, address, correspondence address, PESEL number, telephone number, date of birth, e-mail address, driver's license number, validity date of the driving license, tax identification number, business address, company name. PANEK also processes information regarding the rental period and the registration number of the rented car.
    2. In order to activate the User's account in PANEK Carsharing, the User should send a photograph of their driving license after having covered the following data, which PANEK does not need to perform the User's verification process: face photo, place of birth, date of issue of the driving license, specimen signature, issuing authority.
    3. The photograph of the driving license is removed by PANEK immediately after successful activation of the User's account in PANEK Carsharing, no later than within 24 hours.
    4. PANEK processes geolocation and route data within PANEK Carsharing, necessary to use PANEK Carsharing. Geolocation data is also collected to improve PANEK services based on geolocation solutions and to provide Users with information about services that may interest them due to their location.
    5. PANEK may use Internet logfiles and IP addresses of Users to administer PANEK Carsharing, for statistical purposes, collecting information on errors related to server work, analysis of possible security breaches or website management. The data is used in a way that makes it impossible to identify Users.
    6. PANEK does not process specific categories of personal data within the meaning of the Regulation.
  1. DATA RECIPIENTS.

The recipients of your personal data may be the following entities:

    1. persons authorized by PANEK to process personal data (e.g. employees / co-workers),
    2. data subjects,
    3. PANEK partners with whom PANEK cooperates - in order to conclude or implement the contracts concluded with Users,
    4. authorized by law to obtain information about personal data,
    5. economic information offices,
    6. the acquirers of debt,
    7. entities providing services to PANEK for the purposes of conducting business and subcontractors (e.g. IT, marketing, analytics, telephone or electronic service, payment service, accounting, tax, auditing, legal, debt collection, mediation, delivery of correspondence and shipments, insurance, repair ).

 

  1. THE DATA RETENTION PERIOD.

 

    1. The period of personal data retention varies depending on the type and scope of personal data and the purpose of their processing. If on the basis of the provisions below the same data has been given a different retention period, a longer retention period is applied.
    2. The PANEK shall store Users' data for the time necessary to achieve the objectives set forth in the point III above. Users' personal data will be kept until the contractual claims become time-barred or until the obligation to store data resulting from legal provisions expires, in particular the obligation to keep accounting documents regarding the contract.
    3. In the event that PANEK processes personal data based on the justified interest of PANEK, personal data will be processed until such legitimate interest occurs in the processing of personal data for a specific purpose, however, the data will not be processed if the User raises substantiated objections to such processing, and PANEK does not demonstrate valid legally justified grounds for processing or grounds for establishing, pursuing or defending claims.
    4. If PANEK processes personal data:
      • based on the User's consent - personal data will be processed until it is withdrawn;
      • in connection with cookie technology - personal data will be processed until these files are deleted using the browser or other device settings.
      • Geolocation data and data concerning routes of transit are processed by PANEK for as long as it is necessary for the purposes for which the data was collected (in particular the implementation of PANEK Carsharing) or other purposes resulting from legal provisions, including for the purpose of determining, pursuing or defending claims and handing it over to authorized entities.

 

  1. RIGHTS OF DATA SUBJECTS.

Users are entitled at any time to:

  1. access to personal data, correcting their content, limiting their processing or deletion;
  2. the transfer of personal data, which the User provided on the basis of the consent or to implement the contract, that is, to receive such personal data in a structured, commonly used machine-readable format;
  3. subject to point 4) below - filing an objection at any time - for reasons related to the specific situation of the User - to the processing of personal data concerning the User based on article 6 section point f) of the Regulation, including profiling; PANEK will cease processing personal data, unless PANEK demonstrates the existence of valid legally justifiable grounds for processing that override the interests, rights and freedoms of the User or the grounds for determining, pursuing or defending claims;
  4. object at any time to the processing of the personal data for the purposes of direct marketing, including profiling, to the extent that the processing is related to such direct marketing. After filing the objection, personal data will not be processed.
  5. withdraw at any time the consents given by the User to the processing of personal data (Article 6(1)(a) of the Regulation) without affecting the legality of the processing, which was performed on the basis of the consent before its withdrawal,
  6. file a complaint to the supervisory authority dealing with the protection of personal data (Office for Personal Data Protection).
  1. INFORMATION ON THE AUTOMATED DECISION MAKING, INCLUDING PROFILING.
    1. PANEK analyses activity in the Internet based on profiling, including the use of cookies in order to create and present to the User dedicated offers tailored to the User's preferences as much as possible. Their result may be a favourable, temporary offer addressed to the User based on the history of using the PANEK services and activities on the PANEK websites.
    2. With the use of cookie technologies used on PANEK web pages it is possible to get to know the preferences of Users - e.g. by analysing how often they visit the website, thanks to which PANEK may present the User with a tailored advertisement and create and present offers intended for the User.
  1. INFORMATION ON THE REQUIRED OR THE VOLUNTARY DATA PROVISION 

Providing personal data by the User is voluntary but necessary for the conclusion and

implementation of agreements between the User and PANEK. Providing personal data for marketing purposes is voluntary.

  1. COOKIES
    1. The website panekcs.pl or some of its elements may use cookie files (so-called cookies). Cookies are small files containing IT data, in particular text files, which are stored on the User's end device from which the website is viewed (e.g. computer, laptop, tablet, other mobile devices) and enable, among others, adaptation of the site viewed to the needs and preferences of the User, and also serve PANEK for collecting statistical data. Cookies are not used for identification and based on them, the identity of the visitor to the website is not determined.
    2. Cookies used on the website are not harmful to the User of the end device, therefore PANEK recommends not to disable their use in browsers. Most web browsers accept cookies by default. PANEK informs that limiting or completely disabling cookies may have a negative impact on the operation of the website, including the possibility of using some of its functionalities. However, the user may, at any time, independently determine the terms of use of cookies and restrict PANEK’s access to them via the settings of the web browser used - for example, there is the possibility of partial / temporary restriction or complete disabling of cookies storing. In order to make changes in the use of cookies, it is necessary to change the settings of the browser used. The method of changing the use of cookies varies depending on the browser used, and detailed information on how to delete cookies should be in the appropriate tab of the web browser used by the User (e.g. "Help").
    3. Within the PANEK website, two basic types of cookies are used: "session" and "permanent". Session cookies (temporary files) are stored on the User's end device until logging out or leaving the website. Permanent cookies are stored on the User's device for the time specified in the cookie file parameters or until they are deleted by the User.
    4. The settings of the browser of the device from which the website allowing the storage of cookies is operated mean that the User agrees that these files will be stored on the User's device. If you do not agree to the above, it is necessary to change your browser's settings regarding cookies, as described in point 2 above.
    5. PANEK monitors information on Users using the Google Analitics tool, which records the User's activity on the website.

 

  1. OTHER PROVISIONS.
    1. PANEK applies policies and procedures for the protection of personal data against unauthorized loss, misuse, alteration or destruction in accordance with the law.
    2. PANEK reserves the right to change the content of Privacy Policy, in particular in the case of changes to the applicable law, new guidelines of authorities responsible for supervising the processes of personal data protection, best practices used in the area of personal data protection. PANEK will inform the User about such change by publishing a new content of Privacy Policy on the website.
    3. In the event of any contradictions or doubts between the content of the Policy and the consents given by the Customer, regardless of the content of the Policy, the basis for undertaking and determining the scope of activities by PANEK shall be the consents voluntarily given by the User or the applicable provisions of law. This document is of general nature, for information only, it is not a source of obligations of the User, in particular it does not constitute any agreement or regulations.
    4. The Privacy Policy applies from 1 June 2018.
